On March 14, 2016, Brian Giganti presented the CLE program "How to Apply for Tax Exempt Status" for members of the D.C. Bar along with co-presenters Brian Menkes of the Charles G. Koch Charitable Foundation and Frank H. Smith of Raffa, P.C. The program focused on completing and filing a successful Internal Revenue Service (IRS) Form 1023 or Form 1023-EZ (new in 2014) for a 501(c)(3) tax-exempt organization. The presenters discussed topics including:
- the process of establishing a public charity or private foundation under D.C. law;
- how to apply to the IRS for recognition of the tax exemption;
- incorporation steps and highlighting the standards the IRS applies; and
- strategies for responding to questions the IRS may ask in its review of your organization’s application.
